Sell a Fire Damaged House Across the State Lines

Memphis sits where three states meet, and the thing that makes a Tennessee file distinctive does not cross either line. The statute is Tennessee's and the court is Shelby County's.

The Distinctive Part Does Not Travel

What makes a Memphis fire file unusual is that a neighbour or a nonprofit can start a civil action under the Neighborhood Preservation Act, and that it is heard in a specialist Shelby County court.

Both of those are local in the strictest sense. The Act is a Tennessee statute at Title 13 Chapter 6 of the Tennessee Code. The Environmental Court is a Shelby County court. Neither reaches Southaven, Olive Branch, Horn Lake or West Memphis. The Tennessee position is on our page covering the private right of action.

So Who Can Act About My Property Over Here?

Whoever the relevant state and locality authorise, which is a different question with a different answer in Mississippi and in Arkansas. What you should not do is reason from what you have heard about Memphis, in either direction. Assuming a neighbour can file when they cannot wastes worry; assuming nobody can act when a local authority can is the more expensive error.

Forum Is the Practical Difference

A specialist court that hears these files constantly behaves differently from a general court that sees them occasionally. Timetables differ, familiarity differs, and what a judge expects an owner to have done by a given hearing differs.

For an owner that means advice about a Tennessee file does not transfer to a Mississippi or Arkansas one and vice versa. It is the same reason a contractor licensed on one side of a line is not automatically the right person on the other.

Does That Make Files Over Here Simpler?

Usually more conventional rather than simpler. The distinctive risk of a private plaintiff appearing without warning is absent, which removes a category of surprise. What replaces it is an ordinary code enforcement picture that varies by locality and needs establishing rather than assuming.

We publish no Mississippi or Arkansas requirements, procedures or values for individual properties. Each state and locality states its own position and the relevant county records hold the rest.

Different Counties, Different Records

Shelby County records hold nothing about a DeSoto County or Crittenden County parcel. A search in the wrong county returns a clean result rather than an error, which is the quiet way this goes wrong for owners and buyers alike.

Establishing which county and which state actually holds the parcel is the first step, and a postal address associated with the Memphis area does not settle it.

The Building Does Not Change

What carries across both lines is construction. Housing throughout the metro spans similar eras and the same physics applies.

Older dimensional timber chars on the surface and can frequently be assessed, cleaned back and retained. Later engineered roof trusses and floor systems come out whole once heat has compromised the connections. An engineer's report is worth the same everywhere and is the one document that needs no translation between jurisdictions.

Buyers Vary More Than the Rules Do

Plenty of buyers work all three states comfortably. Some are licensed and experienced on one side only, and a figure from somebody who works mainly in Shelby County on a DeSoto County property may rest on assumptions that do not hold.

Asking how many files a buyer has closed in your specific state is more informative here than almost any other question.

Across the Lines in Context

Where the Act and the court apply in full, see our page about Midtown and Cooper-Young. Where Tennessee suburbs sit outside the city, see our page for the Shelby County suburbs.

The Tennessee Provisions That Stop at the Line

Title 13 Chapter 6 of the Tennessee Code, sections 13-6-101 to 13-6-108, is Tennessee law. Passed in 2004 and amended in 2016, section 13-6-106 carries the private right of action.

Its 30 calendar day certificate window, 60 day receiver reports and 30 day lien period reach no parcel in either of the other 2 states.

Cross-Border Questions

Can a Neighbour Sue Me in Mississippi?

Not under the Tennessee Act, which does not apply there. What Mississippi law permits is a separate question worth asking locally.

Which County Holds My Records?

The one your parcel sits in, most commonly DeSoto or Crittenden rather than Shelby. A Memphis-area address does not settle it.

Will You Buy Across the Lines?

Yes, in all three states. We will establish which rules actually govern the parcel rather than assuming from the address.

Send the Address and We Will Find the Right Forum

We will establish which state's rules govern the parcel, then send a written figure with the arithmetic behind it.
